The collection, storage and sharing of customer information on consumers is an important part of delivering useful banking products and services. To serve you, as a consumer, efficiently and conveniently, we have to make use of modern technology and customer information. But we know that you are concerned about privacy and our use of the information you give us. We are committed to an ongoing review of our procedures and policies in the interest of protecting your privacy. As a result, we have established the following privacy notice to provide guidance in our dealings with consumers.

Definitions

Certain terms in this Notice have the following definitions:

We, our and us means Avenue Bank.

You and Your means consumer customers with whom we have a continuing relationship with such as a deposit account or loan with us, consumers using a special service from us such as ATM transactions without any account, and consumers who have applied for a loan that was declined by the bank or you.

Publicly available information means information lawfully available to the general public from official public records generally from courthouses and information commonly listed in telephone directories or various forms of media and information required by state, federal or local law such as securities filings.

Nonpublic personal information means personal financial information about you that we collect in connection with providing you with a financial product or service that is not made publicly available as described above.

Affiliate means any company we own or control or that owns or controls us.

Nonaffiliated third party means any person, company or partnership that is not an affiliate or joint employee of us.

Consumer reporting agency means an entity that collects and evaluates consumer credit information for the purpose of furnishing consumer reports to third parties.

We collect nonpublic information about you from the following sources:
• Information we receive from you on applications or other forms;
• Information about your transactions with us;
• Information about your transactions with nonaffiliated third parties;
• Information we receive from a consumer reporting agency;
• Information we receive from your employer, prior employer(s);

CATEGORIES OF INFORMATION WE MAY DISCLOSE ABOUT YOU

We may disclose nonpublic personal financial information about you to companies that perform marketing services on our behalf or to financial institutions or securities companies with whom we have joint marketing agreements. We will disclose, as permitted by law, but only if directed by you, nonpublic personal information about you to our affiliates(s) or future affiliate(s). These affiliated companies are or will be financial service providers, such as title companies or insurance companies. We may also disclose nonpublic personal financial information about our customers or former customers as permitted or required by law or authorized by you.

CONFIDENTIALITY AND SECURITY OF YOUR NONPUBLIC PERSONAL INFORMATION

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you and as required by law and regulation.

We maintain physical, electronic, and procedural safeguards that comply with Federal and State standards to guard your nonpublic personal information.

NONPUBLIC PERSONAL INFORMATION ON FORMER CUSTOMERS

If you close your account(s), payoff your loan, or become an inactive customer, we will follow the privacy provisions reflected in this Policy Notice.
